Terms of Service

These Terms of Service ("Terms") govern your use of the Walking Closet mobile app and related services (the "Service"), operated by Walking Closet ("Walking Closet," "we," "us"). By creating an account or using the Service, you agree to these Terms.

If you don't agree, don't use Walking Closet.

1. Eligibility

You must be at least 13 years old to use Walking Closet. If you are between 13 and 18, you confirm you have your legal guardian's permission. Some features may require you to be 18+.

2. Your account

• You're responsible for keeping your password and device secure.
• You're responsible for everything that happens under your account.
• One person per account. Don't share accounts. Don't create accounts for others without their consent.
• You may delete your account at any time from Settings → Privacy → Delete account.

3. What Walking Closet is — and isn't

Walking Closet is a marketplace and communications platform that connects users for non-commercial item swaps and trades. Walking Closet is not a party to any transaction between users. We do not buy, sell, or take custody of items. We do not authenticate items. We do not guarantee the quality, safety, legality, or accuracy of any listing, user, or transaction.

You agree that any transaction is solely between you and the other user. You are responsible for evaluating the item, the other user, and the safety of the meet-up or shipment.

4. Prohibited content and conduct

You may not use Walking Closet to list, trade, post, send, or solicit:

• Weapons, ammunition, explosives, or other items regulated under firearms or weapons law.
• Controlled substances, including illegal drugs, prescription drugs, drug paraphernalia, or cannabis (including in jurisdictions where it is legal — Walking Closet does not facilitate it).
• Tobacco, vaping products, or alcohol.
• Live animals, animal parts, or products that violate wildlife law.
• Human remains, body parts, or bodily fluids.
• Counterfeit, stolen, or recalled goods.
• Adult sexual content, child sexual abuse material (CSAM), or any sexualized content involving minors.
• Content that infringes intellectual property, including counterfeit branded goods.
• Hate speech, harassment, threats, or content that incites violence.
• Spam, phishing, fraud, scams, or schemes to circumvent Walking Closet's fee structure (we don't currently charge fees, but if we add them you may not evade them).
• Anything illegal in your jurisdiction or the other user's jurisdiction.

You also may not:

• Impersonate another person or entity.
• Use bots, scrapers, or automated tools to access the Service.
• Reverse engineer, decompile, or attempt to extract source code.
• Interfere with the Service or other users' use of it.
• Attempt to access another user's account or data.

Violations may result in immediate, permanent account termination. We may also report violations to law enforcement.

5. Reporting and moderation

If you encounter prohibited content or conduct, use the in-app Report mechanism. We review reports within a target window of 24 hours. We may remove content, suspend accounts, or take other action at our discretion. We do not commit to investigating every report or to specific resolutions.

6. Identity and verification

You agree to provide accurate information when you register. Optional face-verification is available — passing it earns a visible "Verified" badge on your profile but is not required to use the Service. Verified status does not constitute Walking Closet's endorsement of the user.

7. Communications and meet-ups

All swap negotiations should happen in-app. We strongly advise:

• Meet in public, well-lit locations for in-person swaps.
• Bring a friend.
• Inspect items before completing.
• Use designated police "safe trade" zones where available.

Walking Closet is not responsible for in-person meetings or shipments. We do not provide escrow, insurance, or transaction guarantees in v1.

8. Intellectual property

You retain all rights to the content you post (listings, photos, messages). By posting content, you grant Walking Closet a worldwide, royalty-free, non-exclusive license to host, display, modify (for technical reasons), distribute, and create derivative works of the content, solely to operate and improve the Service.

You may not use the Walking Closet name, logo, or branding without our written permission.

9. AI features

The Service includes AI-assisted features (listing smart-fill, wishlist parsing, AI search) powered by third-party providers. AI outputs are suggestions only — verify accuracy before relying on them. We do not warrant that AI outputs are correct, current, or fit for any particular purpose.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WALKING CLOSET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WALKING CLOSET'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO ONE HUNDRED US DOLLARS ($100). WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA.

Some jurisdictions don't allow these limits — in that case, the limit is the smallest amount allowed.

12. Indemnification

You agree to indemnify and hold Walking Closet harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your content, your use of the Service, your violation of these Terms, or your violation of any third-party right.

13. Termination

We may suspend or terminate your access to the Service at any time, for any reason, with or without notice. You may stop using the Service at any time by deleting your account.

14. Governing law and disputes

These Terms are governed by the laws of [your governing-law jurisdiction], without regard to conflict-of-laws principles. Disputes will be resolved exclusively in the courts of that jurisdiction, except where applicable law requires otherwise.

If you are a consumer in a jurisdiction with mandatory arbitration restrictions or class-action protections, those provisions take precedence over the above to the extent required.

15. Changes

We may update these Terms. If changes are material, we will notify you in-app at least 7 days before they take effect. Continued use after the effective date constitutes acceptance.
